Welcome to TrainerCompare. These Terms of Service (“Terms”) govern your access to and use of the website trainercompare.com (the “Service”) operated by TrainerCompare (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years old and agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

TrainerCompare is an online platform that enables:

• Trainees to discover, compare, and contact online fitness coaches based on reviews, ratings, pricing, and specializations.
• Coaches to create a professional profile, receive contact requests from potential clients, and manage leads.

TrainerCompare is a marketplace and directory. We do not provide fitness coaching, training, nutrition advice, or any health-related services ourselves. We are not a party to any agreement between coaches and trainees.

3. Account Registration

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Coach Accounts

By creating a coach profile, you represent and warrant that:

• All information in your profile is truthful and accurate.
• You hold all certifications and qualifications listed on your profile.
• You have the right to use all photos and content uploaded to your profile.
• You will respond to contact requests in a professional and timely manner.
• You will not engage in deceptive, misleading, or fraudulent practices.

Coaches are solely responsible for:

• The accuracy of their profile information, pricing, and credentials.
• Their interactions and agreements with trainees.
• Compliance with all applicable laws, regulations, and professional licensing requirements in their jurisdiction.
• Maintaining appropriate professional liability insurance.

TrainerCompare does not verify coach certifications, qualifications, or credentials unless explicitly stated with a “Verified” badge. The presence of a coach on the platform does not constitute an endorsement by TrainerCompare.

5. Trainee Accounts

By using the Service as a trainee, you acknowledge that:

• TrainerCompare does not guarantee the quality, safety, or effectiveness of any coach's services.
• You are responsible for conducting your own due diligence before engaging a coach.
• Any agreement or payment between you and a coach is solely between you and the coach.
• You should consult with a healthcare provider before beginning any fitness or nutrition program.

6. Reviews and Content

Posting Reviews

• Reviews must reflect your genuine, honest experience with a coach.
• You must have actually been a client of the coach you are reviewing.
• You must upload proof of purchase (invoice or receipt) when submitting a review.
• Reviews must not contain false, misleading, defamatory, or fraudulent statements.
• Reviews must not contain hate speech, threats, harassment, or discriminatory language.
• Reviews must not contain personal contact information, links, or promotional content.

Review Integrity

• Coaches may not post reviews of themselves, directly or through third parties.
• Coaches may not offer incentives (monetary or otherwise) in exchange for positive reviews.
• Coaches may not threaten or intimidate clients to remove or alter reviews.
• We reserve the right to remove reviews that violate these Terms or that we reasonably believe to be fraudulent.
• We do not remove negative reviews simply because a coach disagrees with them.

Content Ownership

• You retain ownership of content you post (reviews, photos, videos).
• By posting content on the Service, you grant TrainerCompare a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content in connection with the Service.
• You represent that you have the right to post all content you upload and that it does not infringe any third party's rights.

7. Contact Requests and Lead Quality

• Trainees may submit a limited number of concurrent contact requests to coaches.
• Contact requests must be genuine inquiries from individuals genuinely interested in coaching services.
• Spam, automated submissions, and fraudulent contact requests are prohibited.
• We reserve the right to limit or restrict contact request submissions to maintain lead quality.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Impersonate any person or entity.
• Post false, misleading, or fraudulent content.
• Harass, abuse, or threaten other users.
• Attempt to access another user's account without authorization.
• Scrape, crawl, or use automated means to access the Service without our written consent.
• Interfere with or disrupt the Service or its infrastructure.
• Upload viruses, malware, or other malicious code.
• Use the Service to collect personal information of other users for unauthorized purposes.
• Circumvent any access restrictions or security measures.

9. Intellectual Property

• The Service, including its design, logo, text, graphics, and software, is owned by TrainerCompare and is protected by intellectual property laws.
• “TrainerCompare” is our trademark. You may not use it without our written permission.
• You may not copy, modify, distribute, or create derivative works based on the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAINERCOMPARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless TrainerCompare, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, your violation of any third party's rights, or any content you post on the Service.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in the State of Delaware, United States.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Termination

• You may terminate your account at any time by contacting us at support@trainercompare.com.
• We may suspend or terminate your account at any time, with or without cause, with or without notice.
• Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

16. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on the Service and updating the “Last Updated” date. Your continued use of the Service after changes constitutes acceptance.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrainerCompare regarding the Service.
